Terms of Use

This document constitutes a legal agreement between you and the service operator. It does not constitute legal advice. For specific legal questions — consult an attorney.
1. Nature of the service and registration
Welcome to PushConsole ("the System" or "the Platform"), a B2B SaaS platform for real-time marketing intelligence (RTM). Use of the platform, its components, and offered services is fully subject to these Terms of Use.

- The system is intended for commercial and business use only (organizations, digital agencies, and in-house marketing teams) and is not open to public or open registration.
- Access and adding new users are performed solely by the organization's primary administrator (OWNER) via the settings management panel.
- The platform is based on RBAC: OWNER (full management, deletion, and settings), MANAGER (run scans and view), VIEWER (view only). The user and organization are solely responsible for role assignment.
2. Account security and API keys
- Authentication is via NextAuth JWT (email + password). Users must keep access credentials confidential.
- OWNER may issue, renew, or revoke organizational API keys (`pc_live_...`) for external integration.
- The organization bears sole and full responsibility for API key security. Any action, credit charges, or data leakage from unauthorized use — rests with the organization alone.
3. Credits and payment model
- Manual and scheduled scans (ScanRun) consume credits (CreditLedgerEntry) from the organization's balance.
- Credit and token consumption is displayed on the dashboard (Asia/Jerusalem).
- The operator reserves the right to change pricing models, scan costs, and credit rates, with reasonable advance notice to OWNER.
4. AI use and disclaimer (As-Is)
The system collects public signals (Serper, GDELT) and analyzes them via LLM (Gemini through OpenRouter) to produce SentimentReport.
- System outputs — mood, score, summaries, and recommendations (do/don't, tone, copy) — are automatically generated by AI.
- The service is provided "as is" (AS-IS) and does not constitute binding business, marketing, or legal advice.
- No commitment to accuracy, reliability, or completeness of output.
- No liability for damage, lost profits, or reputational harm resulting from reliance on system recommendations or publishing decisions based on them.
5. Service availability (SLA) and third-party dependency
- The platform relies on Hetzner, AWS (SES), OpenRouter, and other data providers.
- No commitment to 100% uptime.
- No liability for delays, disruptions, or failure to run scheduled scans due to network outages, rate limits (e.g. GDELT), or sub-processor downtime.
6. Intellectual property
All rights — code, architecture, UI, prompts, trademarks — belong to the operator. Use grants a limited, non-exclusive, non-transferable license to produce internal reports only, without transfer of ownership.
7. Limitation of liability and indemnification
- The operator's maximum liability, if established, shall not exceed the amount actually paid by the organization for the service in the three months preceding the event.
- The organization agrees to indemnify the operator against claims, damages, or expenses (including legal fees) arising from unlawful use of the system or breach of these terms by a user on its behalf.
8. Termination
- OWNER may terminate at any time via "Delete organization" in the privacy panel in settings.
- This triggers cascade — deletion of Workspaces, scan history, users, and related data.
- Any user may also delete their personal account via "Privacy and personal data".
9. Governing law and jurisdiction
These terms and any dispute shall be governed by the laws of the State of Israel.
Exclusive jurisdiction: competent courts in the Tel Aviv-Jaffa District.
